Wife's Inheritance When She Dies First: Husband, Mother, and a Single Son
When a wife passes away first, families are sometimes confused about how to divide the property. This example calculates the shares of the husband, mother, and a single son according to KHI, complete with practical steps.
In many families, the division of inheritance is only discussed after the father passes away. Yet a wife may also pass away first and leave property behind. If the deceased leaves a husband, mother, and a single son, what is each one's share? This article provides a general overview according to the Qur'an and KHI. This is not a fatwa; for actual cases, still consult the Religious Court (Pengadilan Agama), a notary/PPAT, or a trusted ustadz.
Heirs in this example
Let us assume the deceased, Bu Sari, has passed away. The surviving heirs are her husband, Pak Dedi; her mother, Bu Nur; and one son named Rizky. The deceased's father has passed away. There are no other children, no binding will, and the estate is clear of debts.
- Husband: alive and Muslim.
- Mother: alive and Muslim.
- Son: alive and Muslim.
- The deceased's full siblings: receive no share because there is a child.
According to KHI, full siblings are excluded by the existence of a child. Therefore, the division in this example involves only the three heirs above.
Basis of shares according to the Qur'an and KHI
The Qur'an, An-Nisa 4:12, sets the husband's share. If the deceased wife leaves a child, the husband receives 1/4. The Qur'an, An-Nisa 4:11, sets the mother's share. If the deceased leaves a child, the mother receives 1/6. The son receives the remainder of the property after the shares of the husband and mother are given. This provision is in line with KHI Book II on inheritance.
If the deceased's father were still alive, he would also receive 1/6 because there is a child. The composition of shares would then be different and would have to be recalculated. Therefore, first make sure who the heirs actually alive at the time of the deceased's death are.
Example calculation for property of Rp240 million
After debts, funeral expenses, and a valid will are settled, the deceased's net estate is worth Rp240,000,000. A will may not exceed one-third after debts and funeral expenses. Here is the division:
| Heir | Basis of share | Share | Value if the property is Rp240 million |
|---|---|---|---|
| Husband | 1/4 because there is a child | 3/12 | Rp60,000,000 |
| Mother | 1/6 because there is a child | 2/12 | Rp40,000,000 |
| Son | Remainder of the property | 7/12 | Rp140,000,000 |
Calculation: Rp60,000,000 + Rp40,000,000 + Rp140,000,000 = Rp240,000,000. The total is exact, with no difference.
If there are later two sons, the 7/12 remainder is divided equally between them. If there is a son and a daughter, the remainder is divided at a ratio of 2:1, meaning the son receives twice the daughter's share.
If the property is a house or land
The figures above also apply to immovable property. For example, a house worth Rp600 million. The husband receives 1/4, namely Rp150 million; the mother receives 1/6, namely Rp100 million; the son receives the remainder of Rp350 million.
A house or land often cannot be divided physically. Common options are to sell it and divide the proceeds, rent it out and divide the income, or have one heir take the asset and pay the other heirs their shares. All options should be put in writing and agreed upon knowingly, without pressure. For the transfer of land rights, involve a PPAT or notary.
Important matters before dividing
- Separate joint property. If the property is joint property of husband and wife, the husband's share is not part of the estate. Only the deceased's share becomes inheritance.
- Record and settle the deceased's debts, including debts that will fall due.
- Pay reasonable funeral expenses.
- Check the will. A will to an heir has its own rules and is not always valid.
- Make sure documents such as the death certificate, family card, and proof of ownership of the property are complete.
Practical steps
- Make a list of the property, debts, and living heirs.
- Calculate the shares with written notes so they can be easily rechecked.
- Deliberate on how to divide the assets, especially if they are in the form of a house or land.
- Obtain a certificate or determination of heirs according to the practice in your area. For Muslims, this is generally through the Religious Court.
- Transfer the certificate and other documents into the heirs' names after the division is agreed.
IndoWaris can help map the family tree and calculate inheritance shares transparently. Nevertheless, the final decision should still be consulted with the Religious Court, a notary/PPAT, or an ustadz who understands faraid. With orderly records and deliberation, the division of inheritance can be carried out without leaving wounds among the family.
